TERMS AND CONDITIONS FOR BOOKING A VISIT TO ROSS FARM MUSEUM
The following booking conditions ("Booking Conditions"), the confirmation invoice, and the Release of Liability, Waiver of Claims, and Assumption of Risks and/or the Ross Farm Museum Visitation Agreement form the basis of your contract with Ross Farm Museum, 4568 Rt. 12, New Ross, NS, company registration number 108090077RR0001.
PLEASE READ THESE BOOKING CONDITIONS CAREFULLY AS THEY SET OUT OUR RESPECTIVE RIGHTS AND OBLIGATIONS. BY ASKING US TO CONFIRM YOUR BOOKING, YOU AGREE THAT YOU HAVE HAD THE OPPORTUNITY TO READ AND HAVE READ THE BOOKING CONDITIONS AND AGREE TO THEM.
These Booking Conditions apply to "visitations" we have sold to you as a "museum". Ross Farm Museum is operated under license from the Government of Nova Scotia by the Ross District Museum Society. All references in these Booking Conditions to a "visitation" or "booking" shall be taken to mean the presence of authorized visitors to the Ross Farm Museum site.
In these Booking Conditions, "you" and "your" means all persons named on the booking (including anyone who is added or substituted at a later date) or any of them, as the context requires. "We", "us" and "our" means Ross Farm Museum staff, management and board of directors.
1. Making your booking
The first named person on the booking ("party leader") represents that they are authorized to make the booking on the basis of these Booking Conditions for all persons named on the booking and by their parent or guardian for all members who are under 19 when the booking is made. By making a booking the party leader confirms that he/she is at least 19 years of age, authorized as set out above and that all party members agree to be bound by these Booking Conditions.
The party leader is responsible for making all payments due to us. The party leader must input the exact number of people in the party of visitors who intend to visit Ross Farm Museum. Failure to indicate the exact number of people in the visitation party may, in the absolute discretion of the museum, result in denial of access to the museum if maximum permissible numbers have been reached. You agree that Ross Farm Museum is not responsible for correcting any errors on the part of the party leader or any other visitor at the time of booking.
Subject to availability, we shall confirm your booking by issuing a confirmation invoice also described as a “receipt”. Your booking is not accepted by us until we dispatch our confirmation invoice to the party leader. Contact us immediately if any information appearing on the confirmation, acknowledgement or any other document is incorrect or incomplete. You agree that Ross Farm Museum is not liable for inaccuracies in any document, if we are not notified within 48 hours of you receiving confirmation.
You must not book a visitation at Ross Farm Museum if you are ill, including, if you are experiencing any symptoms of the 2019 novel Coronavirus (COVID-19), or if you are required to isolate under Provincial regulations or requirements of a health authority. Ross Farm Museum and its management and staff in their absolute discretion may turn away visitors who demonstrate signs of COVID-19 symptoms or if the number of visitors regularly booked for the time-slot in question has already reached the limit of numbers of people permitted on site in accordance with the directives of the Nova Scotia Health Authority pertaining to COVID-19 policies or other policies governing pandemics or public health issues.
You agree that the contact information collected by our booking system will be maintained on record for not less than two weeks after your visitation. This is for contact tracing in case the Nova Scotia Health Authority needs to contact you or members of your party for reasons of public health related to COVID-19. Ross Farm Museum will not disseminate, sell or otherwise make public in any fashion this information except as required by law and upon request by a legally authorized Nova Scotian or Federal public health or safety institution, including its representatives.
2. Payment
In order to confirm your chosen visitation, payment for your and your party’s visitation must be paid online at the time of booking by following the link on the Ross Farm Museum booking website.
If we do not receive all payments due (including any surcharge where applicable) in full and on time, we reserve the right to treat your booking as cancelled by you. In this case, we will be entitled to keep all deposits paid and recover any of the charges due as set out in clause 4. If, in our sole discretion, we do not cancel immediately, you will be required to pay the cancellation charges shown in clause 5 depending on the date we reasonably treat your booking as cancelled.
3. The cost of your visitation
The cost of your visitation is calculated by taking the amount of admissions per person, respecting variations in price according to age or group category, multiplied by the number of persons in your party indicated by you at the time of booking. The prices shown on our website were calculated on April 1, 2020. All prices are in Canadian Dollars.
The booking website charges a fee amounting to 6% of the total price of the booking to the customer for the service of booking your visitation at Ross Farm Museum.
The price of your booking is locked when your booking invoice is produced. The museum is not required to reimburse any fraudulent bookings or any material errors where the museum’s stated prices have not been paid.
4. Changes by you
Should you wish to make any changes to your confirmed visitation, you must notify us in writing via email as soon as possible and at least 48 hours prior to the agreed arrival time.
Where we amend your visitation upon notification, an amendment fee of $2.00 dollars per person/per booking up to a maximum of $5.00 will be payable together with any increased costs and costs incurred by us and any costs or charges incurred or imposed by any of our suppliers or any third party.
5. Cancellation by you
The party leader may cancel your booking at any time by giving us written notice to the email address set out in clause 13 below. Any such notice of cancellation must be given by the party leader, at least 48 hours prior to scheduled arrival. If you notify us by email you should receive a reply within one working day; if you do not receive one you should assume your email has not been received and must contact us again immediately.
Cancellation Charges
Cancellation prior to two working days before scheduled arrival: Free of charge
Cancellation within the two working days before scheduled arrival: $2.00 CDN per person per booking up to a total of $5.00
A reduction in the number of full paying party members will activate the cancellation fee of $2.00 CDN per full paying party member included in the cancellation up to a total of $5.00 CDN.
6. Changes and cancellation by us
We reserve the right to cancel your visitation in our absolute discretion. If it is necessary to cancel your visitation, we will notify you as soon as possible. We will, where possible, offer you an alternative visitation time slot at the same price.
7. Unavoidable and Extraordinary Circumstances
No party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached these Booking Conditions, for any failure or delay in fulfilling or performing any term of the Booking Conditions except for any obligations to make payments to the other party hereunder, when and to the extent such failure or delay is caused by or results from acts beyond the impacted party's ("Impacted Party") reasonable control, including, without limitation, the following force majeure events: (a) acts of God; (b) flood, fire, earthquake, tsunami, epidemics, pandemics including the 2019 novel coronavirus pandemic (COVID-19), OTHER POTENTIAL DISASTER(S) OR CATASTROPHE(S) or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest; (d) government order or law; (e) actions, embargoes, or blockades in effect on or after the date of these Booking Conditions; (f) action by any governmental authority; and (g) national or regional emergency; and (h) strikes, labour stoppages or slowdowns, or other industrial disturbances; and (i) shortage of adequate power or transportation facilities; and (j) other similar events beyond the reasonable control of the Impacted Party.
8. Our responsibility for the performance of the visitation
(1) ROSS FARM MUSEUM NOR ITS DIRECTORS, OFFICERS, EMPLOYEES, NOR AGENTS (THE "RELEASEES") SHALL BE LIABLE NOR HELD RESPONSIBLE IN LAW BY ME, NOR MY HEIRS, EXECUTORS, ASSIGNS AND ANY LEGAL NOR PERSONAL REPRESENTATIVES FOR ANY PHYSICAL BODILY INJURY (INCLUDING BUT NOT LIMITED TO LOSS OF LIFE OR LIMB), PSYCHOLOGICAL INJURY (INCLUDING BUT NOT LIMITED TO POST TRAUMATIC STRESS DISORDER OR OTHER MENTAL ILLNESS), DISEASE, VIRUS, DAMAGE OR OTHER LOSS (INCLUDING BUT NOT LIMITED TO ECONOMIC LOSS) INCURRED BY ME, HOWEVER SUSTAINED OR INCURRED AT ANY TIME DURING MY PARTICIPATION OR ATTENDANCE AT THE ROSS FARM MUSEUM, INCLUDING MY TRAVEL TIME TO AND FROM ROSS FARM MUSEUM. (2) I HEREBY IRREVOCABLY RELEASE AND HOLD THE RELEASEES HARMLESS IN RESPECT OF ANY AND ALL LIABILITY IN AND FOR RESPECT OF MY PHYSICAL INJURIES, PSYCHOLOGICAL INJURY, DISEASE, VIRUS, AND ECONOMIC LOSS DERIVED FROM MY PARTICIPATION, ATTENDANCE, AND INVOLVEMENT, IN ANY MANNER, IN A VISITATION AT ROSS FARM MUSEUM, INCLUDING MY TRAVEL TIME TO AND FROM ROSS FARM MUSEUM. (3) YOU AGREE THAT OUR LIABILITY TO YOU IN CONNECTION WITH YOUR VISITATION SHALL BE LIMITED TO A REFUND OF THE TOTAL COST OF YOUR VISITATION.
9. Your responsibility during the visitation
(1) THE PARTY LEADER SHALL PRESENT A SIGNED COPY OF THE “RELEASE OF LIABILITY, WAIVER OF CLAIMS AND ASSUMPTION OF RISKS” BY EACH MEMBER OF THE PARTY AND WHEN APPROPRIATE THEIR PARENT OR LEGAL GUARDIAN PRIOR TO BEING PERMITTED TO ATTEND THEIR VISITATION AND CARRY OUT THE ACTIVITY OF TOURING THE ROSS FARM MUSEUM.
(2) No person is permitted to access the equipment or animals at Ross Farm Museum unless specifically trained to engage safely with that animal or piece of equipment or under the direct and intentional supervision of a specifically trained Ross Farm Museum staff member.
(3) Due to the COVID-19 pandemic, visitors, subject to exceptions outlined in the Health Protection Act Order (https://novascotia.ca/coronavirus/alerts-notices/), must wear a mask during a visitation at the museum. In addition, visitors, subject to exceptions in the Health Protection Act Order must maintain 6 feet of social distancing at all times. Visitors must not breach rope boundaries or other signage separating visitors from staff and artifacts, for any reason, with the exception of medical emergencies or other immediate matters of health and safety that require evacuation of the space only accessible by breaching the pathway boundary. For the safety of visitors and staff, visitors to Ross Farm Museum must not touch items or structures found on the other side of roped boundary markers. Failure to follow these requirements will result in removal from the museum.
10. Behaviour and damage
You agree that you are responsible for any damage or loss caused by you or any member of your party, including to other persons in your group during a visitation. Full payment for any such damage or loss as reasonably estimated by Ross Farm Museum staff must be paid directly at the time to Ross Farm Museum Staff or to us as soon as possible. You also agree that you are responsible for meeting any claims subsequently made against us (together with our own and the other party's full legal costs) as a result of your actions.
If in our reasonable opinion, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the visitation of the person(s) concerned. The person(s) concerned, in our absolute discretion will be asked to leave the museum premises and cease participation in any other service provided by the museum. We will have no further responsibility toward such person(s). No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination. Failure to comply with directives issued by the government of Nova Scotia and Nova Scotia Public Health Authority is understood to be included in this article.
11. Special Requests and Accommodation
Should you require accommodation under the Human Rights Act for any reason, Ross Farm will provide such reasonable accommodation upon request.
12. Prices and Website Accuracy
You agree that the information and prices shown on our websites may have changed by the time you book your visitation. The price of admission will be the current admission price at the time of your booking. Ross Farm Museum reserves the right to charge contemporary current admissions prices to any individual or group of individuals who arrive at the farm with no prior booking.

14. Severability
If any part of these Conditions shall be deemed unlawful, void or for any reason unenforceable then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of these Conditions.
15. Jurisdiction
We both agree that the laws of the Province of Nova Scotia (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us ("claim"). We both also agree that any claim (and whether or not involving any personal injury) must be dealt with under the jurisdiction of the Province of Nova Scotia.
